By creating an account or using ShootReady's mobile application or web application (together, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
ShootReady provides tools for recording, transcribing, and analyzing interview audio to generate shot lists, reel ideas, and director's notes for video production teams.
You must provide accurate, current information when creating an account and are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately of any unauthorized use.
You are solely responsible for obtaining any and all consents, permissions, and releases required by law from any person you record, photograph, or otherwise capture using the Service, including compliance with all applicable federal, state, and local laws governing the recording of conversations (including "two-party" or "all-party" consent laws that may apply in your jurisdiction or the jurisdiction of the person being recorded). ShootReady is not a party to, and assumes no responsibility or liability for, the underlying recording activity, and you agree that ShootReady has no obligation to verify that you have obtained the necessary consent.
The Service uses third-party artificial intelligence and machine learning tools (including automated speech transcription and language-model analysis) to generate transcripts, shot lists, reel ideas, and director's notes ("AI Output"). AI Output is provided for convenience only and may contain errors, omissions, mischaracterizations, or inaccuracies. You are solely responsible for reviewing, verifying, and editing any AI Output before relying on it for any purpose. ShootReady makes no warranty, express or implied, regarding the accuracy, completeness, or reliability of any AI Output.
Certain plans include a free trial period as described on our pricing page, which may be limited by calendar days, usage (such as the number or length of recordings), or both, whichever limit is reached first. We reserve the right to modify trial terms at any time. Paid subscriptions are billed in advance on a recurring basis until cancelled. You may cancel at any time; cancellation takes effect at the end of the current billing period unless otherwise stated. Fees are non-refundable except as required by law.
You agree not to use the Service to:
You retain all ownership rights to the audio, transcripts, and other content you upload or create through the Service ("Your Content"). You grant ShootReady a limited license to host, store, process, and transmit Your Content solely to provide and improve the Service. We do not claim ownership of Your Content.
The Service relies on third-party providers to function, including audio transcription and AI analysis providers, cloud hosting and database providers, and, for paid plans, a payment processor. See our Privacy Policy for the current list.
THE SERVICE AND ALL AI OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY TRANSCRIPTION OR AI OUTPUT WILL BE ACCURATE OR COMPLETE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHOOTREADY AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, REVENUE, OR PROFITS, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO ANY CLAIM ARISING FROM (A) A RECORDING MADE WITHOUT PROPER CONSENT, OR (B) AN INACCURATE, INCOMPLETE, OR FAILED TRANSCRIPTION OR AI OUTPUT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (I) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (II) $100.
You agree to indemnify, defend, and hold harmless ShootReady and its owners, officers, employees, and affiliates from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) Your Content; (c) your violation of these Terms; or (d) your violation of any law, including recording-consent laws, in connection with your use of the Service.
We may suspend or terminate your access to the Service at any time for conduct that we believe violates these Terms or is otherwise harmful to other users or the Service. You may stop using the Service and cancel your account at any time.
We may update these Terms from time to time. If we make material changes, we will provide notice (such as by email or in-app notice). Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the state and federal courts located in Sonoma County, California, and you consent to personal jurisdiction and venue there.
